I was caught shoplifting today, they said the store is not gonna pressed charges and the cop escorted me to go out of the store. Did I get a criminal record because of that?
No you didn`t since the cop didn`t file any records of you shop lifting this will not be a criminal record.
That`s really a bad situation. But what`s important is you`ve learned your lesson. Please do not do that again.
If you are of minor age, they can`t put this on your record. They will talk to your parents, or then make you do some community services. You also need to pay the item and any casualty or penalty if ever. Try to talk them out, promise anything you could just not to put that on book.
No as you did not leave the store with the stolen merchandise, the store security must wait until you have left the store with the stolen merchandise, and have have reached a certain distance from the store before detaining you and calling the police to arrest you. however they also cannot ban you from store unless they get some sort of restraining or no trespass verdict from judge.
Being that you weren`t arrested or charged with any crime you will be fine in terms of having to appear in court. If you were handcuffed and then charged with shoplifting then you would need to hire an attorney to fight your case but in the way you have described that will not be necessary.
He can tell the security officer that he is sorry for shoplifting and ask the security officer if he and the store manager could arrange for him to do some volunteer work for the store to make good on his reputation, and to show he is truly sorry and will not shoplift again!
You will be banned from the store, ordered to reimburse the cost of the item and possibly have a record. You could offer to do community service and beg for it not to be on your record.
If they wanted to press charges, they would have done it straight away. I think as long as he stays away from the store, he should be fine.
Quite possibly, it may well pay to go back and `clear the slate`.
